Terms & Conditions

These Terms and Conditions ("Terms") govern all purchases from Nidhee Enterprises ("Company"), a business based in Ahmedabad, India. By placing an order, you agree to these Terms.

Orders and Payment

• Company serves Ahmedabad and Gandhinagar exclusively with home delivery.
• Products are sold "as-is"; buyer is responsible for confirming suitability for intended use (e.g., potable water storage).
• All tanks are new and quality-inspected prior to dispatch.
• Orders on In-stock products require minimum 50% advance payment for confirmation; balance due prior to dispatch.
• Orders on Made-to-order products require 100% advance payment for order confirmation.
• No returns accepted; all sales are final upon delivery acceptance.
• Made-to-order products require up to 15 weeks for completion.

Delivery and Shipping

• Delivery timeline: 7-15 working days from full payment confirmation.
• In extreme circumstances (e.g., natural calamities, riots, transport strikes, government restrictions, or force majeure), delays may occur; Company will notify affected customers promptly.
• Free on-site inspection at delivery; buyer must verify condition.
• Accurate address and contact details required; failed deliveries due to buyer error incur a rescheduling fee.
• All prices shown in the catalog exclude delivery charges.

Warranty

• 5-year limited warranty against manufacturing defects (e.g., leaks).
• Claims must be submitted via email (nidhee.enterprise.in@gmail.com) within 7 days of discovery, with photos and invoice.
• Warranty void for: misuse, unauthorized repairs, or 304-grade tanks where stored water TDS is above 250 ppm.
• Remedies limited to repair at Company's discretion; excludes installation, labor, or transport costs.

Cancellation Policy

• In the event of order cancellation, The Client has to forfeit the advance amount, irrespective of the reason.
• Company reserves the right to cancel orders due to stock unavailability or other valid reasons; full refund provided in such cases. No further liability for consequential damages or losses beyond the refunded amount.
• Only for "In-stock" Nilkanth Products:
  • Cancellations pre-delivery: Full refund will be issued less a 25% processing fee calculated on the billed amount.
  • Post-dispatch or delivery: No refunds; rescheduling possible subject to availability (delivery charges deducted from any adjustment).

Limitation of Liability

• Company's total liability is limited to the purchase price of the tank; no responsibility for consequential, incidental, or indirect damages (e.g., property damage, plumbing issues).
• Warranties limited to the 5-year term; post-delivery, buyer assumes all risks. Regular maintenance recommended for optimal performance.

Governing Law and Disputes

• These Terms are governed by the laws of India.
• Exclusive jurisdiction lies with the courts in Ahmedabad.
